Are you ready for Annexation?

Annexation Update- July 2010

 The city of Austin is scheduled to annex Springwoods M.U.D. on December 31, 2010 — what does this mean to the residents of the District? The plan is for Springwoods MUD to convert to a Limited District upon annexation by the city. The Springwoods Limited District will need to be ratified by the voters in May of 2011.

The City of Austin has submitted a Draft Annexation Service Plan which explains the services that the City will provide and those that the Limited District will provide. MUD directors will meet with City representatives to assure that the residents will be fairly served by the city, and to assure that the transition will go as smoothly as possible. A Public Hearing in May was postponed while the Springwoods Board waits for the City’s response to their comments on the Proposed Service Plan.

The next important step for the District is to attempt to reach agreement with the City of Austin regarding changes to the Service Plan by July 1, 2010.  The City has agreed to some changes, but at the present time the Board feels more discussion is required before they can approve the Service Plan. Finalizing this Plan will be required in order for the Board to refine a proposed budget for operation as a Limited District after annexation. When this step is completed, the board will have more complete information to address the concerns of residents of the District.

When the Service Plan negotiations are complete, the Board will call for a Public Hearing to discuss the Plan with the residents. This Public Hearing will be publicized on the web site, a post card will be sent to all residents, and signs will be posted. All residents are invited to monthly Board Meetings which are posted on the web site.

Approximately 55 residents attended the meeting to hear some of the details of the annexation process from the Board, the district's legal representative and some of the contractors and consultants that provide for the district. The questions that the residents had will be presented here on the web site shortly with the answers so that if you were unable to attend you can keep informed. The City of Austin is planning a public hearing on February 23rd. The location has not yet been determined, but the City will be sending a card out to all the residents and the location and time will also be posted here as soon as it is announced.

Many of you may be aware of the fact that the City of Austin is planning on annexing Springwoods M.U.D and areas around it at the end of 2010. The following information is to give you some of the facts of the annexation process and what options are available to the residents of the Springwoods Municipal Utility District.

In 2002, the Springwoods Municipal Utility District (the District) entered into a Strategic Partnership Agreement (SPA) with the City of Austin, which held off full-purpose annexation for a period of five (5) years, this was amended in 2006 to hold annexation off until December 31, 2010. As part of the SPA, the City took over all water and wastewater facilities from the MUD, and assumed responsibility of providing water and wastewater services to the District. The SPA provides for Springwoods MUD to automatically convert into a Limited District on the date the City annexes the area. The Springwoods Limited District will have the responsibilities of:

1.   Maintaining and operating the recreation facilities of the district.

2. Providing additional security for the recreational facilities.

3. To provide Trash collection, recycling, composting, and maintenance of drainage channels.

4. And, to enforce the deed restrictions

After annexation the Limited District will hold an election allowing the residents to approve the continuation of the  Limited District and to give the Limited District the taxing authority to levy property taxes to carry out its responsibilities. One of the major benefits of the Limited District is to keep local control over the amenities and services that the Springwoods residents have come to enjoy.

The City of Austin must provide an “Inventory of Services” for Springwoods MUD and then negotiate a Service Plan for the City of Austin and the Springwoods Limited District to provide services to the District after annexation. The Springwoods MUD Board of Directors is already holding special meetings to prepare for the coming annexation and planning exactly how the Limited District will best be able to serve the residents as effectively and efficiently as possible. The primary goal is to serve and maintain the Springwoods Community.

There are many details to work out within the Municipal Utility District, with the City of Austin staff, and all with the input of the residents of the District. Come to the MUD board meetings, get informed, present your concerns and ideas to the Board Directors. They are your neighbors and dedicated to serving Springwoods.
